Privacy Policy

The present document constitutes the “Privacy Policy” of Berlitz Mexico (hereinafter referred to as “The Company”), a company with address at Jaime Balmes #11 Tower A 2nd floor, by undersigning the present document You (the “Holder”) consent to the use, processing and further dispatch of his or her personal data.

I.- Object. This statement governs the way, the terms and conditions of our Privacy Policy which authorizes and empowers  the Company, including its subsidiaries and affiliated companies, by the Holder  to collect, deal and transfer your personal information (hereinafter referred to as the “Data”).

II.- Excluded Data. The Company's website may include links to third party sites. These third party sites have a separate and independent privacy policies. If you access these third party links, you will be leaving the Company's site. The Company therefore has no responsibility or liability for the content and activities of these linked sites.

Should you publish, comment or share personal information, including pictures, in any chat room, public forum, social network, blog or any other type of public forum, you should bear in mind that any personal information that you publish might be read, seen, collected or used by any other users of the aforementioned forums, and can be used to reach you, send you unsolicited messages or with purposes that neither you or the Company may contro.l In no event shall the Company be liable of any personal information that you decide to send to any of these public forums or social networks.  

III.- Consent. The Holder states under oath the following:

  1. That in case this “Privacy Policy” may be available through any Website, or any other electronic device, when “clicking” on “Accept" or any other way of access to the site, or when you submit your Data through the site, this constitutes a consent so that the Company may use your Data in agreement to the terms of this “Privacy Policy”.
  2. That in case this Privacy Policy may be available through voiced, audiovisual media or through any other type of technology, by undersigning the present document the Holder consents to the use, processing and further dispatch of his/her personal data, in agreement to the terms and conditions of this Privacy Policy
  3. That in case this Privacy Policy may be available through written consent by signing in name, handwritten signature, or fingerprint the present document, the Holder consents to the use, processing and further dispatch of his/her personal data, in agreement to the terms and conditions of this Privacy Policy.
  4. That the information provided is precise and complete. The Holder at all times shall be liable for the Data provided.
  5. The Holder has the right to access, rectify, or eliminate his/her Data, as well as oppose to use of Data or revoke the consent given through the procedures established in this Privacy Policy.

IV.- Sensitive Data. The Holder declares under oath, that has not provided and in any case will not provide the Company any “sensible personal data”, this is, that information whose lawful or unlawful use, may lead to discrimination or may constitute a serious risk for it.

Particularly, the Holder is not obliged to disclose to the Company any sensible personal information, “Sensible Data” are those personal data which reveal the racial and ethnical origin, the political opinions, the religious, philosophical or moral convictions, the trade union affiliation or information concerning the health or the sexual life ot its users.

V.- Data collection. The Holder will provide voluntarily his or her Data to the Company, whether written, verbally, electronically, through surveys, through access to the Company's site or sending email files or any other type of files, including without limitation, direct delivery of information, access to the Company's site or its clients' or affiliates sites (wherever this Privacy Policy may be referred to), telephone calls or telemarketing calls, email applications, seminars, congresses or events, etc.

When using or accessing our website in Internet, we inform you that it may be possible that our systems gather Data from the Holder such as navigation system, operative system, Internet pages visited, IP address, etc. through "cookies"or "web beacons" among others. A cookie is a piece of data automatically downloaded and stored and on a site visitor's hard drive to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site. Usage of a cookie is in no way linked to any personally identifiable information on our site. Web beacon is an often-transparent graphic image that is placed on a web site or in an e-mail. It is used to monitor the behavior of the user visiting the Web site or sending the e-mail. At the same time it can pass along information such as the IP address of the computer that retrieved the image, the time the Web beacon was viewed and for how long, the type of browser that retrieved the image and previously set cookie values.

The Holder accepts the Company may retrieve Data from the Holder by other means, such as Data obtained from other trade sources available, for example, telephone book, corporate directories, business cards, public databases, etc.

All the information and Data collected from the Holder may be combined for the purposes permitted in this Privacy Policy.

VI.- Data use. The Company may use your personal information to:

  1. Improve business transactions.- In case of statistical information, internal statistical analysis, marketing promotions, market researches, business offers, surveys, advertising issues or similar, we may require personal information such as name, address (home and office), phone and fax numbers, email address, information about personal business or consumer preferences, income level, education level, range of age and/or socioeconomic level.

The Data may be used including, but not limited to, (i) Supply to you the products and/or services that you have requested o those that have interested you; (ii) Provide an efficient service and the best customer service possible, as well as to maximize your experience using specific products and/or services; (iii) Send and present to you products and/or services that may seem relevant or attractive that are related to the ones contracted or acquired by the client; (v) Fulfil obligations contracted with our clients; (vi) Assess service quality or conduct internal research about consumer habits.

  1. Contact's Information or work-related.- In case of job applications, curriculum vitae, resumes or work files or any other similar, we may use or deliver Data such as name, address, phones, mobiles, fax numbers, emails, photographies, information about academic degrees, anything related to academic and work records (previous jobs) and information related to interest in positions, including skills and capabilities, contact information, income level and desired positions (including salary).

This Data may be used including, without limitation for, (i) internal affairs in the Company, including keeping them as part of work files within the Company’s Human Resources area; (ii) Recruitment processes or independent outsourcing services; (iii) Providing referrals in case other person or company requires information about a possible candidate for a position, task, or assignment; (iv) legal internal affairs, including in compliance with social security or similar legislation; (v) publishing in case that it may be required as a Human Resources recruitment strategy.

  1. Business transactions information.- In case the Data should be required to fulfil a business transaction, we may collect financial information such as your credit card number; and any other exclusive information, such as user identification number, passwords, billing or transaction information, banking information, etc.

The financial information aformentioned, including credit card numbers, will be used solely for the purpose of processing credit transactions, payments and as fraud prevention.

To this purpose Data may be disclosed and used directly by the Company or trusted third parties to whom Data can be transferred abiding by the terms and conditions established in the following.

VII.- Storing, sharing and transfering Data. Any Data that the Company collects may be stored, processed and transferred between any of the countries in which the Company operates different to that where the Data was collected, in which case we will transfer the information abiding by the applicable privacy policies.

The Holder understands and accepts that the Company is authorized to use, store, share and transfer, as well as to sell, assign, lease or any other way in which the Data can be traded or transferred. In which case the Company will sign agreements with such third parties with whom it shares Data and whom will abide by the restrictions, the terms and conditions of this Privacy Policy.

 Unless expressly provided to the contrary you are in the understanding that you have consented to the transfer of your Data.

Regardless of the aforementioned, the Company will may also share the Data with service or product providers that may need to know this information. Among this suppliers including but not limited to, credit cards processors, customer service suppliers and real time support service suppliers, marketing, email suppliers, automatic data processors and contractors. All the aforementioned service suppliers will be obligated to Data confidentiality in accordance with the terms of this Privacy Policy.

VIII.- Data storage. Once the Data has been submitted, it will be processed and stored in a database which may be administered by the Company or a third party (inside or outside the country where the Data was collected) with whom the Company has a legal contract to that effect.

The Company will take reasonable, technical and organizational precautions to prevent the non-authorized deviation, forgery, loss, misuse, consultation, alteration or treatment of the Data.

IX.- Confidentiality. The Company will not share any Data with any non-authorized third parties unless to satisfy any applicable law, regulation, legal process or enforceable on governmental request.

X.- Accessing, correction. The Holder has the right to access his or her personal information stored in the Company’s database and either correct, limit or update this Data if it is inaccurate or delete such Data at personal request. To this purpose the Holder should send a request via mail or email to the Webmaster, to the following:

The requests to access, correct, remove or oppose Data should have and include the following before processing such requests:

  • The Holder’s name and address or other means to respond to such request;
  • Documents that prove identity or, in its case the Holder’s legal representation
  • A clear and precise description of the personal information you wish to modify according to the aforementioned rights, and
  • Any other element or document that facilitates location of such Holder’s information.

XI.- Cancellation or Revocation. In case of registered Data elimination or consent revocation requests, such shall be done as in the aforementioned.

Personal Data elimination will followed by a blocking process and finally the Data elimination. To the extent that the Company may store such information exclusively to the purposes of the liabilities born out of this agreement.

Whenever the Data may have been transferred before the rectification or cancellation date and the Data may still be treated by third parties, the Company should inform the Holder about this and shall not be liable after such notice.

The Company shall not be obliged to cancel any Data when:

  • It is required to do so by law;
  • It impedes any legal or administrative proceedings binded to fiscal obligations, investigations and crime persecution or in enabling the use of administrative sanctions.
  • It is necessary to protect the Holder’s rights;
  • It is necessary to act in urgent circumstances to protect public safety;
  • It is necessary to comply with legal obligations.

XII.- Modificaciones. The Company deserves the right at all times, to modify the present privacy terms and adapt them to legislative, jurisprudencial up-dates, as well as new market practices.

The Holder agrees that any changes to this “Privacy Policy” or these Terms of Use will be effective upon the earlier of our posting of notice of the changes on the Site It is the Holder’s responsibility to revisit the above Site from time to time to ensure that you stay informed of any such notifications of changes to the Privacy Policy.
